U.S. Investment Visas: E-2 vs. EB-5

Foreign nationals planning to invest in the United States generally consider two major investment-based options: the E-2 Treaty Investor Visa and the EB-5 Immigrant Investor Program. Although both are based on investment, they differ significantly in terms of immigration status, investment requirements, business operation, and the path to permanent residence.

Category

E-2 Treaty Investor Visa

EB-5 Immigrant Investor Program

Visa Type

Nonimmigrant Visa (for business operation/investment)

Immigrant Visa (leads to U.S. permanent residency)

Minimum Investment

No statutory minimum investment. Approximately $200,000–$300,000 is generally recommended, depending on the business.

Statutory minimum: $800,000 for a TEA project / $1.05 million for a non-TEA project

Job Creation Requirement

Hiring appropriate employees based on the size and nature of the business. Employing at least two employees is generally recommended.

Must create at least 10 full-time jobs for qualified U.S. workers

Direct Business Operation

Required — the investor must directly develop and operate the business.

Not required — investment through a Regional Center is possible, including indirect investment.

Path to Permanent Residency

No direct path to a green card; a separate immigration process is required.

Conditional permanent residency is granted, and after satisfying the conditions for 2 years, the investor may obtain unconditional permanent residency.

E-2 Treaty Investor Visa

The E-2 visa is a nonimmigrant visa for nationals of treaty countries, including South Korea, who make a substantial investment in a U.S. business and develop and direct the enterprise.

There is no fixed statutory minimum investment amount for E-2. The investment must be substantial in relation to the type and size of the business and sufficient to support its successful operation.

EB-5 Immigrant Investor Program

EB-5 is an immigrant investment program that allows qualifying investors to pursue U.S. permanent residence by making the required investment and meeting applicable job creation requirements.

Unlike E-2, EB-5 is designed for investors whose primary goal is to obtain a U.S. Green Card through investment.

Which U.S. Investment Visa Is Right for You?

E-2 may be appropriate for investors who plan to directly operate and develop a business in the United States.

EB-5 may be appropriate for investors whose primary goal is U.S. permanent residence through investment.

Choosing the appropriate U.S. investment visa requires careful consideration of the investor's source of funds, business structure, investment plan, immigration objectives, and applicable legal requirements.
